Serving civil subpoenas or other civil requests for user data on OpenAI

This page provides information for attorneys and individuals or parties seeking to serve OpenAI OpCo, LLC (OpenAI) with a request for user data in civil proceedings. OpenAI responds to civil requests for user data that are validly served on OpenAI in accordance with applicable law. We carefully review all such requests, and will produce information only as permitted under applicable laws. We will notify users before any data is disclosed, where legally possible and appropriate.

This process applies only to civil requests for user data. OpenAI’s policies regarding law enforcement and government requests for user data are described in OpenAI’s Government User Data Request Policy(opens in a new window). Civil requests for user data in the United States

OpenAI will accept civil requests for user data (including subpoenas and court orders) that are issued from the Santa Clara Superior Court or the U.S. District Court for the Northern District of California. OpenAI will also accept out-of-state legal process that is properly domesticated through a California court.

You can serve OpenAI with civil requests through OpenAI’s registered agent, CT Corporation System (“CT Corp”), at any authorized CT Corp office where service is permitted under applicable law. For example, CT Corp can be served in California at the following address:

OpenAI does not accept service by email, fax, regular mail, or through customer support channels.

OpenAI Ireland Limited is the data controller for users located in the European Economic Area (EEA) and Switzerland.

Civil legal process relating to these users must be served on OpenAI Ireland Limited using legally valid service methods under Irish law and applicable cross-border service frameworks, including where applicable:

  • EU service regulations; and
  • the Hague Service Convention.

OpenAI Ireland Limited does not accept service by email, fax, regular mail, or through customer support channels.

OpenAI evaluates civil legal process in accordance with its policies and applicable law.

To enable efficient processing, civil legal process should:

  • constitute valid and enforceable legal process under applicable law;
  • clearly identify the OpenAI product or service at issue;
  • include sufficient information to identify the relevant account(s), where applicable (such as an email address);
  • state with particularity the categories of records or information sought;
  • specify the relevant time period for which information is requested; and
  • include the court name, case caption, and case number.

OpenAI may be unable to identify accounts based solely on names, IP addresses, physical addresses, or phone numbers. Incomplete or overly broad requests may be rejected or require clarification. If your request seeks user data about a counter-party to your litigation, OpenAI may object to producing any data if you have not exhausted your efforts to obtain the data through party discovery.

Contractual notices are different

If you are providing notice under a contract (not legal process), please follow the notice provisions in the applicable OpenAI agreement.
